Terms of Service
These terms govern your use of the Tier One Performance ("T1OS", "we", "us") coaching platform. By creating an account, purchasing a program, or booking a session, you agree to what follows. Plain language, no surprises.
Eligibility & accounts
- You must be at least 13 years old to create an account; athletes under 18 need parent or guardian consent, coordinated through their coach.
- You are responsible for keeping your login credentials confidential and for any activity that happens under your account.
- Provide accurate information at signup and keep it current. Deliberate misrepresentation is grounds for suspension.
The service
T1OS provides tools that let coaches program training, athletes log workouts, and both parties communicate. We may update features, add new capabilities, or retire ones that no longer serve users. If we materially change how the service works in a way that affects an active paid plan, we will give you reasonable notice.
Purchases, memberships & refunds
- One-time purchases (programs, drop-ins, merchandise) are non-refundable once the content has been delivered or the session has been attended, unless we or your coach explicitly authorize a refund.
- Recurring memberships renew automatically at the interval shown at checkout until you cancel. You can cancel anytime; access continues through the end of the paid period.
- Cash-eligible reservations hold the item for you, but access does not activate until your coach records the cash payment in-person.
- Payments are processed by our third-party payment provider. All prices are shown at checkout in the listed currency, exclusive of any local taxes that may apply.
- If you believe you were charged in error, contact your coach in-app and we will investigate promptly.
Coach & athlete relationship
The programming, coaching feedback, and services delivered through T1OS are provided by the coach you engage with — not by the platform itself. Coaches are independent professionals responsible for their own advice, credentials, and conduct. Your training data is visible to your coach so they can do their job.
Training & health disclaimer
Strength and conditioning carries inherent physical risk. By using the platform you confirm that you are physically able to participate, and you accept responsibility for your own safety. Consult a licensed healthcare provider before starting any new training program, especially if you have a pre-existing condition, are pregnant, or are recovering from injury. T1OS and its coaches do not provide medical, nutritional, or physical therapy diagnoses.
Acceptable use
You agree not to:
- Redistribute, resell, or publicly post programming, workouts, or coaching content you purchased or accessed as an athlete.
- Attempt to reverse-engineer, scrape, or interfere with the platform, its APIs, or other users' accounts.
- Upload content that infringes intellectual property, violates privacy, or is unlawful, harassing, or hateful.
- Use the platform to send unsolicited marketing.
Content & intellectual property
- T1OS retains ownership of the platform software, brand, and any content we author. Your license to use the platform is personal, revocable, and non-exclusive.
- Coaches retain ownership of the programming they publish; athletes get a personal, non-transferable right to use it for their own training.
- You retain ownership of the notes, videos, and logs you upload. You grant T1OS the limited rights it needs to operate the service (store, transmit, display back to you and your coach).
Privacy
Our Privacy Policy explains what we collect, how we use it, and the choices you have. By using T1OS you agree to those practices.
Termination
You can close your account at any time by contacting your coach or emailing us. We may suspend or terminate accounts that violate these terms or that put other users at risk. If we terminate an active paid plan without cause, we will refund the unused portion.
Disclaimer & limitation of liability
The service is provided "as is". To the fullest extent permitted by law, T1OS disclaims all implied warranties (merchantability, fitness for a particular purpose, non-infringement). We are not liable for indirect, incidental, or consequential damages. Nothing in these terms limits liability for gross negligence, willful misconduct, or anything else that cannot be limited under applicable law.
Changes to these terms
If we make material changes, we will update the "Last updated" date and notify active accounts by email before the change takes effect. Continued use after the effective date means you accept the revised terms.
